Maintenance Membership Plans -Terms and Conditions

These Terms & Conditions (“Agreement”) are entered into between ClimaCore HVAC & R LLC (“Provider”) and the customer (“Client”) upon enrollment in a maintenance plan (Chill Mode Club or Frost Elite Club). By subscribing and making payment, the Client agrees to the following:

  1. Scope of Services

Provider will perform preventive HVAC maintenance at Client’s premises located at [Client Address], as outlined in the selected plan and the service checklist (Annex A).

 

Chill Mode Club Plan Includes:

✅2 annual visits (spring and fall)

✅FREE Basic HVAC Tune-Up

✅5% discount on repairs

✅Emergency service priority

✅Up to 5% discount on selected Parts & Equipment

✅Priority service scheduling

 

Frost Elite Club Membership includes:

✅2 Annual Maintenance Visits (Spring and fall)

✅Full diagnostics and performance testing

✅FULL HVAC System Tune-Up, Deep cleaning of system components to improve air quality and efficiency

✅10% discount on repairs

✅SAME-DAY service guaranteed within 12 hours, no matter the season

✅1 FREE Emergency Calls per /yr.

✅Up to 10% discount on selected Parts & Equipment

✅24/7 Emergency Service priority

✅FREE high-efficiency filter replacements with each visit

 

  1. Term & Renewal

This Agreement is valid for 12 months from the enrollment date.

At the end of the term, it will automatically renew for successive 12-month periods unless Client provides written notice of cancellation at least 30 days prior to the renewal date.

  1. Service Frequency

Maintenance visits will be conducted semiannually (spring and fall) according to the plan selected.

  1. Provider Responsibilities

Perform all tasks in accordance with the plan checklist.

Use qualified technicians and appropriate equipment.

Deliver a written (and photographic, if applicable) service report after each visit.

Notify Client of any issues or abnormalities observed.

  1. Client Responsibilities

Provide access to indoor and outdoor equipment during scheduled visits.

Ensure utilities (electricity and water, if required) are available.

Make timely payments according to the plan selected.

Cover the cost of parts, repairs, or replacements not included in the plan.

  1. Fees & Payments

Client agrees to pay the membership fee of $[amount] (monthly or annual, depending on plan selection).

Payments are non-refundable. In case of early cancellation by Client, no refunds will be issued for payments already made.

  1. Warranty Disclaimer

Preventive maintenance does not guarantee uninterrupted equipment operation but ensures all necessary activities are performed to extend system life and maintain warranty compliance.

  1. Limitation of Liability

Provider shall not be responsible for failures caused by:

Misuse or abuse of equipment,

Extreme environmental conditions,

Power supply issues, or

Damage by third parties or natural events.

  1. Early Termination

Client may cancel at any time with written notice. However, no refunds will be issued for payments already made. Services not yet performed will be considered forfeited.

  1. Governing Law & Venue

This Agreement is governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Orange County, Florida.

By completing payment and enrollment, Client acknowledges and accepts these Terms & Conditions.
